SUMMARY:Afrofuturism and the Law
DESCRIPTION:Panel discussions on the topic of “Afrofuturism and the Law”\n\n\nLong before the film Black Panther captured the public’s imagination\, the cultural critic Mark Dery had coined the term “Afrofuturism” to describe “speculative fiction that treats African-American themes and addresses African-American concerns in the context of twentieth-century technoculture.” Since then\, the term has been applied to speculative creatives as diverse as the pop artist Janelle Monae\, the science fiction writer Octavia Butler\, and the visual artist Nick Cave. But only recently have thinkers turned to how Afrofuturism might guide\, and shape\, law. The participants in this workshop explore the many ways Afrofuturism can inform a range of legal issues\, and even chart the way to a better future for us all. \n★ This free online workshop will feature contributors to a special issue\, guest edited by Bennett Capers (Law\, Fordham)\, in the open-access online journal Critical Analysis of Law: An International & Interdisciplinary Law Review\, published in March 2022 (click here to read). \nThis is an online event. SUMMARY:War Crimes Committee Conference - Session 5: Legal pluralism and the International Criminal Court
DESCRIPTION:Traditionally States and their domestic laws were considered the starting point in relation to adjudicating crimes and maintaining legal order. In today’s globalized world we have seen the development of the fields of international human rights law and international criminal law\, emerging as international legal regimes on their own. Those international legal regimes have a variety of sources\, stemming from different legal traditions and different world views. This is the case especially with international criminal law\, where different rules apply simultaneously\, and have the potential to clash and create challenges during the adjudication process. Therefore\, there is a need to address the plurality of rules that might be applicable with relation to a single international criminal case\, as well as their relationship and hierarchy. Our distinguished speakers will address the followings among other issues: The ICC’s Procedural Regime: the 1998 Model at its 24 Year Road Test. Is Islamic law\, as some have argued\, so radically different and unsupportive of international criminal justice? or can it contribute to the effective implementation of international criminal justice in the modern world? What are the potential tensions between Islamic notions of penal law and those international criminal rules adjudicated by the ICC? Is there a Place for Culture in International Criminal Justice?

SUMMARY:War Crimes Committee Conference - Session 4: The challenges to undertaking domestic and hybrid trials for atrocity crimes
DESCRIPTION:Many feel that accountability for atrocity crimes is best undertaken in the communities where the crimes occurred and that the victims call home.  However\, this assumption has been questioned by some based on past experiences.  This moderated event will discuss the challenges of establishing domestic and hybrid courts\, including political\, legal\, societal and resource hurdles.  Building upon lessons learnt (such as from the Special Court for Sierra Leone\, Extraordinary Chambers in the Courts of Cambodia\, Iraqi High Tribunal and the Special Tribunal for Lebanon)\, the panel will explore current situations needing accountability measures\, for example South Sudan.  While the International Criminal Court understandably garners much attention\, it intervenes only when the relevant State is unwilling or unable genuinely to carry out an investigation or prosecution.  The panel will consider options to end impunity for atrocity crimes\, starting with the affected State.

DESCRIPTION:In recent years\, many nations have adopted ‘Global Magnitsky’ and other human rights-centred sanctions regimes\, in an effort to freeze the assets of those committing atrocity crimes or human rights abuses\, on top of the existing sanctions regimes focused on counter-terrorism\, drug trafficking and cross border illicit financial flows. The world has already seen the use of general and targeted sanctions during times of armed conflict or atrocity crimes\, including in respect of Afghanistan\, China\, Myanmar\, Syria\, Yemen and now Russia-Ukraine. This panel will provide practitioners with information on the sanctions process – from the investigation and imposition of sanctions\, to implementation and enforcement\, to eventual seizure and use in reparations or restitution awards. The panel will also discuss the impact of sanctions on civilian populations\, including humanitarian aid efforts\, and the complexities involved with general and specific licences.

SUMMARY:Fading Entity Boundaries in Comparative Corporate Law
DESCRIPTION:This seminar is one of four that will take place in May\, June and July 2022.\n\n\nTogether with the Department of Law\, University of Mannheim\, the Centre for Business Law and Practice (University of Leeds) continues in 2022 the Leeds/Mannheim Online Seminar Series\, which was launched last year.\n \nAbstract:\n \nThis Article examines the treatment of legal entity boundaries in the application of corporate law and shareholder rights in groups of companies – a critical issue given that large corporations typically have hundreds of subsidiaries. By analyzing this question in several key jurisdictions over time\, it identifies and explains the erasure of entity boundaries in the application of corporate laws around the world\, a phenomenon which it terms “entity transparency.” Corporate law rules in groups of companies increasingly apply on a pass-through basis\, a gradual development that has accelerated in the twenty-first century. There are\, however\, relevant differences in the embrace of entity transparency across jurisdictions\, which means that global convergence in shareholder protection is more limited than previously assumed. Moreover\, contrary to conventional understandings\, there is little correlation between a jurisdiction’s willingness to disregard entity boundaries to support shareholder rights\, on the one hand\, and to impose shareholder liability for the benefit of creditors\, on the other. The rise of entity transparency in corporate law challenges the prevailing view that overcoming corporate separateness between parent companies and subsidiaries requires exceptional circumstances\, and offers new doctrinal and functional grounds for developments in other areas of law.\n \nBiography:\n \nMariana Pargendler is Global Professor of Law (Spring 2022) at NYU Law in Buenos Aires. She is Professor of Law at Fundação Getulio Vargas (FGV) Law School in São Paulo\, where she is also a director of the Center for Law\, Economics\, and Governance. Her scholarship examines problems in corporate law\, corporate governance\, and contract law from an economic and comparative perspective. She holds an LL.B. and a PhD (Law) from the Federal University of Rio Grande do Sul (Brazil)\, as well LL.M. and J.S.D. degrees from Yale Law School. While at Yale\, she was a research fellow at the Millstein Center for Corporate Governance and Performance at the Yale School of Management\, as well as an Olin fellow at the Center for Studies in Law\, Economics\, and Public Policy at Yale Law School. Prior to joining academia\, she was a corporate associate at the New York office of Weil\, Gotshal & Manges LLP.\n \nThis one-hour event will take place via Zoom and will be recorded. SUMMARY:War Crimes Committee Conference - Session 2: Workplace culture at the International Criminal Court (ICC)
DESCRIPTION:In recent years the issue of workplace culture has become a critical focus of legal practitioners working in international criminal justice institutions such as the International Criminal Court (ICC). A 2019 IBA global survey of almost 7\,000 lawyers uncovered widespread bullying and harassment in the legal profession\, and a 2021 IBA global survey of almost 3\,500 legal professionals confirmed that there is a mental wellbeing crisis in the legal profession\, one which has a disproportionate impact on women\, young people\, those who identify as an ethnic minority and those with disabilities. Lawyers working in the international criminal law field are speaking up about their experiences and frustrations with the ‘old boys’ club’ mentality that persists in many offices. Whether it’s bullying and harassment – including predatory behaviour – toxic environments or work-related secondary trauma\, lawyers are advocating for a shift towards creating safe\, healthy and inclusive working conditions. This panel will explore the effectiveness of efforts underway at the ICC to confront the systemic causes of misconduct\, such as new vetting processes for the election of officials\, the development of effective reporting mechanisms and new forms of mandatory training.

SUMMARY:War Crimes Committee Conference - Session 1: The situation in Ukraine
DESCRIPTION:Since the beginning of Russia’s invasion of Ukraine on 24 February 2022\, there have been multiple reports of violations of international humanitarian law and other atrocity crimes. An unprecedented 41 state parties to the Rome Statute have referred the situation to the International Criminal Court and many experts have called for the establishment of a new tribunal with jurisdiction over the crime of aggression to deliver justice in respect of the events in Ukraine. At the same time\, domestic trials pursuant to universal jurisdiction have increased in prevalence in recent years\, presenting a further route to justice. This panel will address the institutional avenues that may potentially be utilised to investigate\, prosecute and adjudicate the crimes reported to have occurred in Ukraine in connection with the invasion. In this context\, it will examine ‘the principle of complementarity’\, immunities and the jurisdictional parameters that apply to each option for justice.

DESCRIPTION:Join Executive Director Justin Reash in discussion with Mr. Ankit Malhotra\, Mr. Gopal Subramanium\, and Dr. Zareer Masani.\n\n\nAnkit Malhotra has a Bachelor of Arts Degree in International Relations from the Jindal School of International Affairs. During his Bachelor studies and ongoing studies of Law\, he has written\, published and spoken extensively on international relations and international law. He co-founded the Jindal Society of International Law which\, under Malhotra’s leadership\, has hosted international speakers from the International Law Commission\, United Nations\, Institute of International Law\, World Bank and Hague Academy of International Law. \nMr Subramanium was the youngest lawyer to be designated a Senior Advocate by India’s Supreme Court and has appeared as lead counsel in a number of landmark cases. Between 2009 and 2011 he served as Solicitor General of India\, and was presented with the National Law Day Award for Outstanding Jurist by the President of India in 2009. One of Mr Subramanium’s most important contributions to legislation in India was to improving India’s sexual violence laws. Mr Subramanium is a generous benefactor of the Oxford India Centre for Sustainable Development. In 2018\, he was elected as an Honorary Master of the Bench\, the Honorable Society of Gray’s Inn and in 2019\, Mr Subramanium was elected as a Foundation Fellow of Somerville\, the College’s highest recognition for philanthropy. \nZareer Masani is the author of Macaulay: Britain’s Liberal Imperialist (Bodley Head\, 2014). He has an Oxford history doctorate and is the author of three other historical books: Indira Gandhi: A Biography (Hamish Hamilton\, 1975)\, Indian Tales of the Raj (BBC\, 1987) and India from Raj to Rajiv (BBC\, 1988). He has also written a widely acclaimed family memoir\, And All Is Said: Memoir of a Home Divided (Penguin\, 2013). Zareer spent two decades as a current affairs producer for the BBC and is now a freelance historian\, journalist and broadcaster. He has presented and produced several documentaries for BBC Radio 4. Zareer’s particular areas of interest are UK race relations\, British imperial history and the legacies of the Raj in India.
